Our terms of sale and website use, in plain English. They cover quotes and orders, delivery, cancellations, your consumer guarantees, and how a dispute is resolved if one ever arises.
01About these terms
Casualife Australia Pty Ltd (ABN 59 638 041 022), trading as Casualife Furniture ("Casualife", "we", "us", "our"), is an outdoor furniture importer and retailer based in Victoria, Australia. These terms and conditions ("terms") apply to every order placed with us and to your use of this website, whether you are a private individual, a business or a trade customer.
You accept these terms by placing an order, creating an account, or otherwise using this website. If you do not agree with them, please do not order from us or use the site. We may update these terms from time to time — see clause 14 (General).
02Quotes & orders
A quote we issue is valid for 30 days from its date, unless it states otherwise. Prices, availability and lead times in a quote can change after that period.
An order is formed only once we have accepted it in writing — for example, by email confirmation — and, where a deposit is required, once that deposit is paid as stated on your quote. Placing an order or making a payment does not by itself guarantee our acceptance: we may decline or cancel an order before it is confirmed, including where a piece has become unavailable, where information you have given us is incomplete or incorrect, or where we reasonably suspect fraud.
03Prices & payment
Pricing is quoted per project or per order and is set out on your quote. Your quote states whether that price is inclusive or exclusive of GST. Payment terms — including any deposit, progress payment or balance due before delivery — are as stated on your quote. If a payment term matters to you and is not stated on it, ask us before you order.
04Delivery & lead times
All delivery dates and lead times we give you — on a quote, an order confirmation, this website or otherwise — are estimates only and are subject to change. Much of our range is manufactured overseas and shipped to Australia, and timing depends on manufacture, ocean freight, port handling, customs clearance and other steps outside our direct control.
Where a delay arises from manufacture, shipping, customs clearance or an event outside our reasonable control, we may extend an estimated delivery date by a reasonable period. We may also re-route a shipment, split your order into more than one shipment, or change the sequence in which items in your order arrive, where doing so helps us fulfil the order.
Risk in the goods passes to you on delivery. Title — ownership — does not pass until we have received payment in full. Please inspect your goods on delivery and tell us about any visible damage or shortage within a reasonable period; this helps us resolve it quickly and does not affect any right you have under the Australian Consumer Law.
05Force majeure
Neither party is liable for a failure or delay in performing its obligations under these terms to the extent that failure or delay arises from an event reasonably beyond that party's control — including supplier or manufacturing delay, freight or shipping disruption, port or customs action, industrial action, or a natural event (a "force majeure event"). The affected party's obligations are suspended for as long as the force majeure event continues, and that party must take reasonable steps to reduce its effect and keep the other party informed.
If a force majeure event continues for a prolonged period, either party may cancel the affected order by written notice. If we cancel on this basis, we will refund any amount you have paid for goods that have not been delivered.
06Cancellations & changes
If you are a consumer, you may cancel your order and receive a full refund of your deposit within 48 hours of us confirming your order, provided the items ordered are from our standard range and have not yet entered production.
Custom, made-to-order and cut-fabric items cannot be cancelled once production or fabric cutting has begun, except where the Australian Consumer Law requires it. Outside the 48-hour window, or once production has begun, a cancellation is at our discretion.
We will accommodate changes to your order where production allows — the earlier you tell us, the more likely we can.
07Consumer guarantees
Nothing in these terms excludes, restricts or modifies the consumer guarantees that apply to your order under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), or any other right that the law does not allow us to exclude, restrict or modify.
Where goods fail to meet a consumer guarantee, your remedy depends on whether the failure is major or minor. For a major failure, you can choose a refund, a replacement, or to keep the goods and be compensated for the drop in their value. For a failure that is not major, we will remedy it within a reasonable time — usually by repair, replacement or refund, at our choice. These rights sit alongside, and are not limited by, any warranty a manufacturer offers.
08Commercial & trade customers
Clause 7 applies to every order, including trade and commercial orders. Where the goods are not of a kind ordinarily acquired for personal, domestic or household use, section 64A of the Australian Consumer Law allows us to limit our liability for a failure to meet a consumer guarantee. To the extent the law allows it, our liability for such goods is limited, at our option, to: replacing the goods or supplying equivalent goods; repairing the goods; paying the cost of replacing the goods or of acquiring equivalent goods; or paying the cost of having the goods repaired.
09Natural materials & weathering
Outdoor furniture is made from natural and performance materials that are expected to change with use and exposure. Teak weathers to a silver-grey patina, powder-coated finishes may show wear over time, and outdoor fabrics perform and age according to their construction and exposure. A characteristic that is consistent with the manufacturer's own guidance for that material is not a defect. Care guidance for the materials we sell is available on request and, where published, on this website.
10Intellectual property
This website, and its text, layout and design, belong to Casualife or our licensors. Catalogue pages, photography and fabric imagery on this website remain the copyright of their respective houses — including Kingsley Bate, iSiMAR, Varaschin and Calma — and are used with their permission. You may view and download material from this site for your own personal use or for a genuine enquiry or order; you may not otherwise reproduce, redistribute or commercially use it without our permission or that of the relevant copyright owner.
11Privacy
Our Privacy Policy explains how we collect, hold, use and disclose personal information, and forms part of these terms.
12Disputes
If a dispute arises under these terms, please contact us first at marilla@casualife.com.au — most issues are resolved quickly by talking to us directly. If we cannot resolve a dispute between us in good faith, either party may refer it to mediation in Victoria before starting court proceedings, except where a party seeks urgent injunctive or similar relief. Nothing in this clause limits your right to contact Consumer Affairs Victoria or the Australian Competition and Consumer Commission (ACCC) at any time.
13Governing law & jurisdiction
These terms are governed by the law of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and any court competent to hear an appeal from those courts.
14General
If any part of these terms is invalid or unenforceable, the rest continues to apply. These terms, together with your order confirmation and quote, are the entire agreement between us for that order and replace anything discussed beforehand. We may vary these terms by posting an updated version on this website; where a change is material, we will tell account holders. You may not assign your rights under these terms without our consent; we may assign our rights, including to a related company or to a purchaser of our business.
